Diploma Terms & Conditions
Definitions:
Business Student: a party who enrols on a Diploma and is acting in the course of a business
Code of Practice: the PETbc Code of Practice as set out and published on the PETbc website from time to time
Diploma: one of the PETbc Diplomas offered on the PETbc website
Module: a module on a PETbc Diploma
PETbc: Pet Education Training & Behaviour Council Limited
Privacy Policy: the PETbc Privacy Policy a link to which is contained in the PETbc website.
Interpretation:
Any reference to we, us, or our means the PETbc.
Any reference to you means you the student.
Where to find information about us
You can find what you need to know about us, the Pet Education, Training & Behaviour Council before you book to undertake a Diploma on our website or by contacting us using the contact details on our website. When you book to undertake one of the Diploma’s you agree with the following terms and conditions of booking: –
1.Rules and Regulations The PETbc web site may from time to time contain specific rules and regulations, in addition to a Code of Practice applicable both to PETbc members, affiliate members and also insofar as is applicable to students enrolling on a Diploma. You are therefore expected to comply with these rules regulations and the Code of Conduct insofar as they are applicable to any of your activities in relation the undertaking of a Diploma.

2.1 When you book a PETbc Diploma through our website you are asking to enter into a contract with us to provide the education services contained within the Diploma you have booked. The contract is not complete until we accept that request and acceptance can be deemed by either initial email confirmation of acceptance from the course tutor or despatch of the course materials by email to the email address you have provided withing your booking form on our website.
2.2 We reserve the right at all times to reject an application to enrol on one or more of the PETbc Diploma’s at our absolute discretion.
3. Payment
3.1 The Diplomas are modular and the tuition fee is taken at the start of each module, before any Diploma materials are despatched. Module 1 has a tuition fee that must be paid in full upon enrolment. Module 2 has a tuition fee that is payable once Module 1 has received a pass grade and before commencement of Module 2.
3.2 Students will be charged fees for each Diploma at rates established by the PETbc and published on our web site. The fees and availability of a Diploma may be subject to change.
3.3 The fees include despatch of course materials and tuition costs and do not include other costs, such as, but not limited to, books (including recommended reading if any), films, supplies, equipment costs and any other costs whatsoever associated with the selected Diploma. These additional costs are your responsibility.
3.4 Payment can be made by credit or debit card via PayPal (you do not need to be a PayPal member). The PETbc will take all reasonable care to keep the details of your booking and payment secure, but we will not be held liable for any loss you may suffer if a third party procures unauthorised access to any data you have provided when accessing or ordering from the PETbc website. Nothing in this clause excludes any liability for fraud.
3.5 It is your sole responsibility to ensure that all tuition fees for each Module are paid for at the beginning of the Module.
4. Cancellation and Refund Policies
4.1 By paying the Diploma fee and securing a place on a Diploma, you are committing to completing the Diploma, and are, as such, liable to pay the full course fees as outlined on our website at the time of booking.
4.2.1 The Diploma course materials will contain full details of the Diploma, the Module that you are enrolling on and that you will be studying, together with fees, dates and tuition schedules. If having reviewed this information you do not wish to commence the relevant Module you have a legal right to change your mind about your order within 14 days of receipt of the Module course materials. Therefore if for any reason, you decide to cancel your booking of the relevant Module within 14 days of the date of receipt of course materials from us and notify us (using the Contact Form on our website) within this 14 day period a full refund will be issued to you.
4.2.2 Course materials will have deemed to have been delivered to you upon delivery to the email you have provided to us when booking your Diploma.
4.3 After 14 days from deemed delivery of the Diploma course materials in accordance with 4.2.2 above any refund is at our sole discretion. You agree that we will not be obliged to provide you with a refund after 14 days of receipt of Diploma course materials in the following circumstances:
- A change in your personal or family circumstances.
- Minor health issues
- You no longer have time to complete the Diploma.
- Your work circumstances have changed.
- You no longer wish to continue the course.
4.4 If a refund is payable to you, we will provide you with a refund by the same means the Diploma Module was paid for, therefore if PayPal was used to pay the tuition fee, PayPal will be used to refund you. You will not be charged for a refund where payable.
5. Ownership of PETbc Course Materials:
5.1 All course materials that we supply to you are the exclusive property of the PETbc. These are provided to you to use for the purposes of undertaking a PETbc Diploma and for no other purpose. They remain the property of the PETbc at all times and you must not use, reproduce, distribute or otherwise share or disclose the course materials or any part of them to any other person, persons, company, business or other entity.
5.2 If you cancel a Diploma or a Module you must delete all of our course materials provided to you in relation to the same. You must not use, reproduce, distribute or otherwise share or disclose the course materials or any part of them to any other person, persons, company, business or other entity. All PETbc Diploma course materials are protected by copyright law.
6. Extension of Time to Complete Diploma Course Work
6.1 You can apply for a deferral of the course work set out in a Module that has not been commenced and we will at our sole discretion in what are considered by us to be extraordinary circumstances authorise an extension of time for such period as we may agree with you in writing. You must use the Contact Form to apply for such a deferral.
6.2.1 If you have begun the course work set out in a Module, but due to unforeseen circumstances have a need to suspend completely continuation of your coursework for a period of time you must contact your course tutor to notify them without undue delay once you are aware that you will need to suspend your studies with us.
6.2.2 Your course tutor will consider the circumstances and may at their discretion allow you to postpone continuation of the Module. An open-ended postponement will not in any circumstances be considered. If your tutor agrees to a postponement this will be for a specified period as set out by your tutor.
6.2.3 Where we agree to the suspension and re-instatement of a Module you will NOT be entitled to any refund in respect of the fee paid for commencement of the Module and upon re-instatement onto the Module a reasonable and proper reinstatement fee will be payable by you to us as specified by us prior to re-commencement of the Diploma.
7. About the PETbc – Including Rules, Policies, Procedures and Codes of Practice
7.1 Information published on the PETbc web site contains details of or reference to certain policies, rules, procedures and other information about the PETbc which may be relevant to the provision of a Diploma or your decision to book onto one. We reserve the right to publish changes to all or any information contained within our website including without limitation Diploma course content, tuition fees and any policies, rules, code of practices, or procedures on our website at any time and without prior notice.
7.2 Notwithstanding the provisions of clause 7.1 above once you are enrolled onto a Diploma and whilst you are continuing the same, you will be notified of any changes referred to in clause 7.1 above, albeit it will be your responsibility to familiarise yourself with the content of them.
7.3 You are expected to read and be familiar with the information contained in the website immediately prior to booking a Diploma. By booking a Diploma, you agree to abide by all relevant policies, rules and procedures and agree to comply with the same.
8. Successful Completion of a PETbc Diploma
8.1 The PETbc approves and accredits all of its own Diplomas and Modules which are marked by PETbc tutors and their decision in this regard (except in the case of manifest error) is final.
8.2 Your completed coursework is not graded, but marked as a PASS or FAILURE. However, your work will be largely a dialogue throughout the submission between yourself and your tutor who will support and assist you insofar as is reasonable in the circumstances to achieve successful completion of your Diploma.
9. PETbc’s Rights to Terminate enrolment on a Diploma
9.1 The PETbc reserves the right to terminate your enrolment on a Diploma in the event of:
9.1.1what we reasonably consider unsatisfactory academic progress;
9.1.2 failure to pay tuition or fees or to pay them by specified or agreed deadlines;
9.1.3 disruptive or inappropriate behaviour by you including without limitation behaviour that is detrimental to the PETbc or our reputation;
9.1.4 you, in our reasonable opinion, posing a danger to the health or welfare of your own clients, animals, other members of the PETbc or the PETbc membership (including affiliate members);
9.1.5 your failure to abide by any PETbc rules, regulations, policies, or procedures published from time to time or other obligations;
9.2 If your enrolment on a PETbc Diploma is terminated for a reason specified in this clause 9. You will not be entitled to a refund of all or part of the relevant Module fee that you have paid, or any prior Module fee within the same Diploma.
10. Your Success
You acknowledge that your successful completion of and satisfaction with a Diploma is dependent upon your individual efforts, abilities and application to the requirements of the Diploma. We do not make any warranties or guarantees as to the ease with which you will be able to complete a Diploma or in respect of your ability to successfully complete it.
11. Internet
Use of the internet or any other resource material in order to complete any requisite coursework for a Diploma is solely at your own risk and subject to prevailing regulations regarding access, display and utilisation of material available on the worldwide web. Any websites utilised by you including any referred to or recommended in your coursework or by your tutor will have been recommended with good intention. However such websites are not monitored by us and any recommendation does not imply that we are aware of current content, nor can we be responsible for any loss suffered as a result of access to or the information contained in such websites. They are recommended solely for your use in research and information collation in relation to Diploma requirements. We make no endorsements nor do we make any warranties regarding the content of such material.
12. Grievance Procedure
If you that you have been treated unfairly or unjustly during your studies at the PETbc, you must submit a written statement of the grievance via the Contact Form immediately. Where the grievance concerns an academic process, such as a pass or fail of a Module or an assignment, the PETbc Director of Educational Development is allocated the task of handling such grievances and they will review your grievance and use reasonable endeavours to report back to you with their decision within 30 days of submission of your grievance. For other types of grievance the coordinator will determine the appropriate action in the circumstances according to current PETbc policy.
13. PETbc Liability
13.1 It is essential that students enrolling on PETbc Diplomas fully appreciate that there are risks of damage to property and injury or death to themselves, other persons and animals when learning in a practical environment with animals that may be unpredictable.
13.2.1 Whilst the PETbc and all personnel associated with the delivery of diplomas will never encourage you to take any unnecessary risks whilst completing practical aspects of any coursework within a Diploma, we are not in a position to judge your level of competence in the practical application of tasks set in real life situations. We therefore expect you to be fully responsible for all necessary health and safety considerations during the implementation of the same and to ensure a safe environment for yourself and the people and animals you may be working with or around.
13.2.2 You WILL BE ENTIRELY RESPONSIBLE for your own actions when working with humans/and or animals and must ensure at all times that you do not carry out such activities beyond your own level of competence and experience. We will not provide advice as to how to deal with a specific case or circumstance. Any advice we provide is of general application and all real life circumstances you work in need to be individually reviewed and assessed by you personally and will be your responsibility.
13.2.3 We will not compensate you for any damage, or loss incurred by yourself or as a result of any liability you incur to any third party during undertaking the tasks required by the Diploma you are undertaking, as specified in clause 13.2.2 it remains your responsibility to assess and ensure that the circumstances in which you undertake any task required by a Diploma are such that you can safely carry out the requisite task.
13.3.1 Where you are a Business Student Neither the PETbc nor any individual or organisation associated with Diploma delivery can accept any liability in negligence (other than insofar as the law does not allow us to exclude liability) for any claim for damage, losses, harm or expenses, or other liability whatsoever, arising from your activities pursuant to completion of a Diploma, including without limitation from the application of advice or training provided on the Diploma. You are at all times responsible for your own actions when working with people, dogs and/or other animals in the capacity of carrying out tasks required by or associated with completion of a Diploma, or providing either behavioural advice or training (whether or not such advice or training relates to work required as part of a Diploma).
13.4 You must ensure that where appropriate you have sufficient and public liability insurance in place to cover any potential liability you may incur.
13.5 The PETbc shall not be liable under, or in connection with, these Terms and Conditions in any of the circumstances specified in this clause 13 or representations pre – or post contract (other than fraudulent or negligent representations) or otherwise for any loss of business, contracts, profits or anticipated savings or for any indirect or consequential economic loss whatsoever. Liability in all events is restricted to, and shall not exceed, the tuition fees paid.
14. You agree the following:
14.1 You have read, understand and agree to comply with these terms and conditions as may be modified and notified to you from time to time. You agree to comply with all of the PETbc policies and rules contained within the PETbc website from time to time and/or notified to you by us during the course of completion of a Diploma.
14.2 You confirm and agree no representations or statements have been made to you by the PETbc or any representative of the PETbc regarding any aspect of the education and training you will receive from the PETbc other than those in the Diploma coursework and these term and conditions. You understand that each Diploma is offered on-line and has published start and end dates.
14.3 You understand that you may require books, films for each Diploma and/or Module and are responsible for purchasing these separately.
14.4 You confirm that all information provided in your application for enrolment on a PETbc Diploma is complete, accurate and up to date.
14.5 You have read these terms and conditions and understand that confirming so electronically when booking into a Diploma constitutes your confirmation in lieu of a signature and that you agree to these terms and conditions.
15. Privacy Policy
How we use your personal data that you provide us with is set out in our privacy policy
16. Rights of Third Parties
Nobody else has any rights under this contract. This contract is between you and us, nobody else can enforce it or has or can acquire any rights under it.
17. Delayed Enforcement of Breach of Contract
Even if we delay in enforcing this contract, we can still enforce it later. We might not immediately chase you for not doing something, such as making a payment, or for doing something you are not allowed to do but that does not mean we cannot do it later.
18. Invalidation of Contract Clauses
If a court invalidates some of this contract the rest of it will still apply. If a court or other authority decides that some of these terms are unlawful the rest will continue to apply.
19. We Are Not Responsible For Delays Outside of Our Control
If there is a material delay in the supply of course materials or marking of coursework by an event outside of our control we will contact you as soon as possible to let you know and do what we can to reduce the delay. As long as we do this, we will not compensate you for the delay, but if the delay is likely to be substantial you can contact us using the Contact Form to end the contract and receive a refund for any outstanding Module(s) you have paid for in advance but not received, less any reasonable costs we have already incurred.
20. Governing Law
You and we agree that this contract is governed by the laws of England and Wales.
